CANE CREEK POLICIES

Cane Creek Cycling not only supports a network of Certified Service Centers globally, but also provides Factory Direct Service.  For all information concerning the service or warranty of your Cane Creek Cycling Component please submit a ticket.

We have been standing behind our products since our company was established here in North Carolina in 1975, first as Dia-Compe, then starting in 1996 as Cane Creek Cycling Components. While no product is perfect, it is very important to us to uphold our hard-earned reputation for innovation and quality. In the event that you experience a problem with a Cane Creek product due to a suspected defect in materials or workmanship, please contact us or our representative in your country promptly. If Cane Creek determines that the reported problem was in fact caused by a defect in materials or workmanship, the affected product will be repaired or replaced, by a comparable model, at Cane Creek’s sole option.  Neglect, lack of maintenance, use beyond what the product was designed for, or modification to the product can void the warranty. The product warranty applies to the original owner.

Cane Creek Cycling Components has determined that its interests and the interests of its retailers are best served through a minimum advertised price (“MAP”) policy. This MAP policy is designed to (1) protect retailer margins so that desirable pre-sales and post-sales services and infrastructure can be provided by our channel partners; and (2) support the Cane Creek Cycling Components brand as a premium offering. Although resellers remain free to establish their own prices, Cane Creek Cycling Components retains the right to, without warning, and without assuming any liability, cancel any pending orders, and deny access to any product/vendor where the customer is in violation of the pricing policies. This policy has been unilaterally adopted by Cane Creek Cycling Components.

This MAP policy covers all U.S. Cane Creek Cycling Components retailers. Although retailers remain free to establish their own resale prices, Cane Creek Cycling Components will, without assuming any liability, unilaterally determine whether a retailer has failed to adhere to this MAP policy. Cane Creek Cycling Components will not discuss any conditions of acceptance related to this MAP policy, as it is non-negotiable, and will not be altered for any retailer. Cane Creek Cycling Components neither solicits, nor will it accept, any assurance of compliance with this MAP policy. Nothing in this MAP policy or in any other contract or agreement with Cane Creek Cycling Components shall constitute an agreement between Cane Creek Cycling Components and retailer that the retailer will comply with this MAP policy.

MAP applies only to minimum advertised prices and does not apply to the price at which the products are actually sold, or to advertised prices higher than the unilateral MAP established by Cane Creek Cycling Components from time to time.

Minimum Advertised Pricing
The current product catalog and listing of products are published in the Cane Creek Cycling Components pricelist. The MAP shall not be less than the MSRP/MAP listed on the published Cane Creek Cycling Components pricelist. MSRP pricing is the set MAP pricing. The pricelist may be changed from time to time at the sole discretion of Cane Creek Cycling Components. Cane Creek Cycling Components retailers are responsible for remaining current with MAP policy, products and pricing. Any advertisement below the MAP will be a violation of the policy. MAP Policy Guidelines are applicable to all resellers. Authorized retailers advertising (internet, catalogue, billboards, television, radio, mass media, direct mail, email, etc.) any products may not advertise products at a price less than the applicable MAP, and may not advertise any discounts, rebates, credits, or similar price reduction that serves to reduce the net advertised price below MAP, whether any such reduction is expressed in terms of specific dollar amounts or more generally described as a reduction from MAP or the selling price.

Policy Violations
Cane Creek Cycling Components reserves the right to decline to make further sales to retailers who do not adhere to this MAP policy. Failure to adhere to this MAP policy shall be determined by Cane Creek Cycling Components in its sole discretion.

Policy Modifications
Cane Creek Cycling Components reserves the right at any time to modify, suspend, or discontinue the MAP policy in whole or in part or designate promotional periods during which the terms of the policy change or designate periods of time during which the policy is not applicable. Contact Information – All questions or comments regarding this MAP policy are to be directed to the policy administrator at MAP@CaneCreek.com. The policy administrator shall be solely responsible for determining whether a violation of the policy has occurred, communicating decisions to retailers regarding the policy and receiving any communication regarding this policy.

PRIVACY POLICY
At CANE CREEK, we value privacy, and we believe in transparency. With these principles as our guide, we developed our Privacy Policy (“Policy”) and want all Users to know that we gather certain types of information when they visit our website, and we want all Users to know what we do with that information. If you disagree with our Privacy Policy, please do not use this website. Keep in mind that our Policy may change from time to time, but it will always be updated when you visit our website.

SCOPE
This Policy applies to data collected in connection with products and services offered by CANE CREEK or from other interactions with us where a link or other appropriate reference of incorporation to this Policy is made, as well as other services such as customer care and warranty services, customer events, or promotions and campaigns. Our products or services may also contain links to other companies’ websites and other third-party services that have privacy policies of their own. We recommend that you carefully read the privacy policies of such services. CANE CREEK is not responsible for the privacy practices or contents of any such third-party services.

DATA COLLECTED
We collect two general types of information from Users: Personal Data (such as names and e-mail addresses); and Aggregate Data (such as information about traffic patterns on this site; for example, how many users log into this site on a daily basis).

Personal Data is collected when Users provide information to CANE CREEK, for example in registering for electronic newsletters or other membership services, in answering surveys, purchasing items from the Store, registering to bid on items available at an online auction, and/or registering for contests and other promotional opportunities provided by CANE CREEK. When Users register or request information on this website, we generally need their name, e-mail address, mailing address, day phone number and credit card information (only when ordering products through our web-based store), as well as create a username and password. In addition, if Users send us personal correspondence, such
as e-mails or letters, we may collect such information into a file specific to that User. Please also see the section “Use of Cookies and Web Beacons” below.

Aggregate Data, such as which page Users access and information volunteered by Users, such as survey information and/or site registration information, is collected through various methods. In the course of using our website, we also automatically track certain information about Users. This includes the URL they just came from, which URL they go to next, what browser they are using, and their IP address. An IP address is a number that is automatically assigned to a User’s computer whenever they’re surfing the web. Web servers, the computers that “serve up” web pages, automatically identify their computer by its IP address, and when they request a page from us, our servers log your IP address. We do not link IP addresses to anything personally identifiable, so although their session will be logged, they will remain anonymous to us.

Data Obtained from Third Parties may be obtained certain companies and other publicly available sources, in accordance with applicable laws. This may include personal data such as credit information and address information updates.

COOKIES
Cookies are small files that our website may place on User’s computer or mobile device (“Device”) via User’s web browser. Cookies contain information that is transferred to User’s Device’s hard drive. Some of the cookies store information required for this website to function optimally. Other cookies help us improve the website for Users by tracking how many people visit the website, which pages they visit, and how frequently.

Some cookies are deleted at the end of each browser session. These are called “session cookies”. They allow website operators to link User’s actions during a browser session. A browser session starts when a User opens the browser window and finishes when they close the browser window. Other cookies remain on your Device for a longer period (as specified in the cookie). These are called “persistent cookies”. They are activated each time Users visit the website that created that particular cookie.

Users may block cookies by activating the setting on their browser that allows them to refuse the setting of all or some cookies. However, blocking all cookies (including essential cookies) may prevent the website from operating optimally. Unless Users have adjusted their browser setting so that it will refuse cookies, our system will issue cookies as soon Users visit our site. Turning off or deleting cookies will not prevent device identification and related data collection from occurring.

Once you have consented to our use of cookies, we shall store a cookie on your Device to remember this for next time. This will expire periodically. If you wish to withdraw your consent at any time, you will need to delete your cookies using your internet browser settings. For further information about deleting or blocking cookies, please visit: www.aboutcookies.org

The information we obtain using standard Internet technology, such as web beacons and other similar technologies, enables us to customize the services we offer Users, to deliver targeted content and advertisements, and to measure the overall effectiveness of our online content, advertising, or programming.

We may share this information with distributors, marketing partners, and advertisers, with whom we collaborate. We must release User’s credit card information to credit card authorization service providers and associated banks to process payments for products or services purchased on this website. In addition, if we use service providers, these service providers may have access to User’s personal information to perform contractually specified services on our behalf.

We may use the information Users provide in an anonymous or aggregated format that does not identify Users personally, which might include, without limitation, to evaluate existing products, services, and systems; to assist in the development of new products or services; research; advertising; and to identify trends and changes.

We may disclose personal information in any of the following circumstances: (a) in response to a subpoena, search warrant, court order, or other legal process or request, or as may otherwise be required by law, rule, or regulation; (b) to protect and defend our rights or property or those of our affiliates or business partners, or others; or (c) as we, in our sole discretion, believe is appropriate under exigent circumstances in response to a perceived threat to the personal safety, property, or rights of any person or organization.

In addition, since our database is a business asset, in the event we are reorganized or become part of another organization, Users consent to the sale, assignment, or transfer of their personal information to a successor that acquires substantially all of our business assets, or to an affiliate, as applicable.
